General terms and conditions for consumers and customer service

With customers (that means natural persons who close a legal transaction for a purpose which can be attributed neither to their commercially professional occupation nor to their freelance professional occupation) ordering on our online shop the following general terms and conditions are applied - each with the version which is valid at the time of order.

1. General information/Conclusion of an agreement

For business transactions with Lanitz-Prena Folien Factory GmbH the following regulations of the German Civil Code are applied. The product presentations in the online shop serve for submitting an offer to buy. With clicking on the button Normal 0 21 [order obliged to pay] you submit a binding offer to buy. We only sell our products for private use. After ordering you will  first of all receive an automatic e-mail which confirms the receipt of your order and which contains these general terms and conditions and which advises you of your right of withdrawal. However, this e-mail does not represent an acceptance of contract. We can accept your order by sending a confirmation of order by e-mail or by delivering the goods within five work days. 2. Right of withdrawal

Consumers have a two-week right of withdrawal.

You may revoke your contractual agreement in writing (e.g. letter, fax or e-mail) within two weeks without statement of reasons or - if you received the goods prior to the expiry of this period - by returning the merchandise. The deadline starts after receipt of this instruction in writing but not prior to the receipt of the goods by the recipient (in the recurring supply of similar goods not before receipt of the first partial delivery) and also not before we have met our information duties according to article 246 § 2 in conjunction with § 1 (1) and 2 EGBGB (Introductory Act to the German Civil Code) as well as our duties according to the first sentence of § 312e (1) of the German Civil Code in conjunction with article 246 § 3 EGBGB. In order to meet the revocation deadline it is sufficient to dispatch the revocation or goods in time.

Consequences of withdrawal

In the event of an effective withdrawal any mutually received service has to be returned and possible benefits that may have been accrued (e.g. interest) have to be released. If you are not able to return the goods or only return them partially or in a deteriorated condition you will be obligated to pay a compensation for lost value accordingly. In the case of the goods being delivered this does however not apply if such deterioration is entirely attributable to their inspection - as it would have been possible for you in, for instance, a retail outlet. You do not have to pay a compensation for lost value for a deterioration due to the utilisation of the good as intended.

Goods suitable for delivery by parcel are to be returned at our risk. You have to bear the costs of the return if the delivered goods conform with the ordered ones and if the price of the returning goods does not exceed an amount of 40.00 Euros or if in the case of a higher price of the goods you have not yet performed the service in return or any partial payment as agreed upon by contract at the point in time of revocation. Otherwise, the return consignment is free of charge for you. Goods not suitable for delivery by parcel will be picked up at your place. Obligations to refund payments must be met within 30 days. For you, the period begins upon dispatch of your statement of revocation or of the goods, for us, upon receipt of them.

The right of withdrawal does not apply to goods which have been produced according to customer specifications or unmistakably adapted to personal requirements.

3. Prices

The prices stated on the product pages include VAT and other price components and are exclusive of postage.

4. Forwarding costs

We charge a lump sum of 6.00 Euros for every delivery within Germany. Starting from an order value of 150.00 Euros delivery within Germany is free of charge. Forwarding cost for deliveries abroad have to be enquired separately. Outside of the EU, delivery is effected VAT-free. Any possibly additional customs or taxes have to be paid by the recipient.

5. Terms of delivery

Delivery will be made within Germany as well as within the EU. On separate enquiry a worldwide delivery will also be possible. The delivery period is approx. 2-3 days within Germany. We will indicate possibly different delivery periods on the corresponding product page. For deliveries abroad you have to expect longer delivery periods.

6. Payment

Payment will be made optionally by advance payment, credit card, direct debit, PayPal or immediate transfer. If you select the method of payment advance payment we will indicate our bank data at the confirmation of order. The invoice amount has to remitted to our bank account within 10. When paying by credit card your account will be debited on dispatch of the goods. When paying by direct debit you have, if necessary, to bear costs, which may arise due to a back transfer of a payment transaction for lack of funds or because of falsly indicated bank data by you. The right to set off a claim is only given when your counterclaim has been legally proved or is uncontested or has been acknowledged by us in written form. You may only exercise a right of retention as far as it is a matter of claims resulting from the same contractual relationship.

7. Reservation of property rights

The goods remain our property until the purchase price is completely paid. Before the passing of ownership the customer is not entitled to pledge or assign as security or process or remodel the goods without our consent.

8. Warranty

Warranty will be given in accordance with legal regulations.

9. Liability

We exclude our liability for any damages due to simple negligence except where material contractual duties, damage or injury to life, body or health, guarantees or claims under the Product Liability Act are concerned. The same applies for any breaches of duty by our vicarious agents.

10. Final clauses

Should any provision of these general terms and conditions be invalid the remainder of the contract will remain valid. The relevant legal provisions will apply in place of any invalid provision.

German law applies to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

How does the shopping cart system work?

Products can be reserved non-bindingly by clicking on the button [add to shopping cart]. You can always look at your shopping cart by clicking on the button [shopping cart] and you can remove products from your shopping cart by clicking on the button [delete] if necessary. If you would like to buy the products in your shopping cart click on the button [proceed to checkout].

Do I need to register?

After selecting the products you will be asked to indicate your data. The compulsory data are marked with *. You can optionally open a customer account and in future you can order after entering your user name and your password without needing to indicate your contact data once more.

When will my order be binding?

On the order page you will be able to check your entry once more. By clicking on the button [order obliged to pay] you complete your order. The transaction can be stopped at any time by closing the browser window. On the single pages you will receive further information, e. g. on correction possibilities.

Will the wording of the contract be saved?

We save the wording of the contract. The order data and the general terms and conditions will be sent to you by e-mail. After completing the order your order data cannot be accessed by Internet any more for safety reasons.
