Right of withdrawal

You may revoke your contractual agreement in writing (e.g. letter, fax or e-mail) within two weeks without statement of reasons or - if you received the goods prior to the expiry of this period - by returning the merchandise. The deadline starts after receipt of this instruction in writing but not prior to the receipt of the goods by the recipient (in the recurring supply of similar goods not before receipt of the first partial delivery) and also not before we have met our information duties according to article 246 § 2 in conjunction with § 1 (1) and 2 EGBGB (Introductory Act to the German Civil Code) as well as our duties according to the first sentence of § 312e (1) of the German Civil Code in conjunction with article 246 § 3 EGBGB. In order to meet the revocation deadline it is sufficient to dispatch the revocation or goods in time.

Consequences of withdrawal

In the event of an effective withdrawal any mutually received service has to be returned and possible benefits that may have been accrued (e.g. interest) have to be released. If you are not able to return the goods or only return them partially or in a deteriorated condition you will be obligated to pay a compensation for lost value accordingly. In the case of the goods being delivered this does however not apply if such deterioration is entirely attributable to their inspection - as it would have been possible for you in, for instance, a retail outlet. You do not have to pay a compensation for lost value for a deterioration due to the utilisation of the good as intended.

Goods suitable for delivery by parcel are to be returned at our risk. You have to bear the costs of the return if the delivered goods conform with the ordered ones and if the price of the returning goods does not exceed an amount of 40.00 Euros or if in the case of a higher price of the goods you have not yet performed the service in return or any partial payment as agreed upon by contract at the point in time of revocation. Otherwise, the return consignment is free of charge for you. Goods not suitable for delivery by parcel will be picked up at your place. Obligations to refund payments must be met within 30 days. For you, the period begins upon dispatch of your statement of revocation or of the goods, for us, upon receipt of them.

The right of withdrawal does not apply to goods which have been produced according to customer specifications or unmistakably adapted to personal requirements.
